In 2022/3, the parties signed the "Prenuptial Property Agreement," stipulating that the property shall belong solely to plaintiff Chen, and defendant Li voluntarily relinquished all rights to the property. Both parties signed and fingerprinted the agreement. In 2024/5, plaintiff Chen filed a lawsuit with the court requesting divorce from defendant Li and confirmation that the property belongs solely to her.

4.Present evidence that the parties explicitly agreed in the agreement that the property in question shall belong solely to the plaintiff, that the defendant voluntarily waived all rights, and that this agreement is legal and valid. Therefore, the property should be awarded solely to the plaintiff.

Processing Result

The court ruled to grant the divorce between plaintiff Chen and defendant Li. The property located in Huli District, Xiamen City, shall be awarded solely to the plaintiff Chen, who will also be responsible for repaying the remaining mortgage. The defendant shall bear all litigation costs of this case.
