In a support dispute case in Xiamen, the court ruled that children must pay their parents 2000 yuan per month.

Case Summary

Plaintiffs Wang and Lin are a married couple, both over 80 years old. They are elderly, in poor health, lack the ability to work, have no other sources of income, and require support from their children. The plaintiffs have three adult children: Wang1, Wang2, and Wang3. All three children have stable incomes and the financial capacity to provide support, yet they have failed to fulfill their obligation to support their parents. They have not paid any alimony or provided daily care for the plaintiffs. Despite multiple requests by the plaintiffs for their children to fulfill their duties, all were refused. Consequently, the plaintiffs filed this lawsuit requesting that each child pay 2000 yuan per month as alimony and jointly cover the plaintiffs' medical expenses.

Key Dispute

1.Should the three children fulfill their obligation to support and pay alimony to the two plaintiffs?
2.Is the amount of alimony claimed by the plaintiff reasonable?

Case Strategy

1.Core evidence such as proof of fixed family relationships, age and health certificates for the two plaintiffs, and income verification for their children.
2.Provide evidence that both plaintiffs are over 80 years old, are elderly and frail, lack the ability to work, have no other sources of income, and require child support.
3.Demonstrate that, in accordance with the Civil Code, adult children have an obligation to support, assist, and protect their parents.
4.Adult children who fail to fulfill their duty of support shall be required by parents lacking labor capacity or living in financial hardship to pay maintenance fees.
5.Taking into account the combined monthly income of the three children and considering Xiamen's cost of living as well as the actual needs of the two plaintiffs, we request that each child pay alimony of 2000 yuan per month. This arrangement ensures joint coverage of the plaintiffs' medical expenses, complies with legal provisions, and is reasonable in amount.

Processing Result

The court orders defendants Wang 1, Wang 2, and Wang 3 to each pay the plaintiffs Wang and Lin a monthly support allowance of 2000 yuan, effective from the date this judgment takes effect. Medical expenses incurred by plaintiffs Wang and Lin shall be borne equally by defendants Wang 1, Wang 2, and Wang 3 upon presentation of official receipts. All litigation costs for this case shall be borne by the three defendants.
