II. How is 2N compensation calculated?
Compensation for illegal termination of employment equals twice the economic compensation standard. Economic compensation is calculated as years of service multiplied by the average monthly wage. For service periods of six months or more but less than one year, count as one full year; for periods under six months, count as half a year.
For example: 2 years and 3 months of work, monthly salary of 8000 yuan; severance pay equals 2.5 multiplied by 8000 multiplied by 2, totaling 40000 yuan.
III. Proper Ways to Legally Terminate Employment
1. Rules and regulations must be established through democratic procedures and made public to employees.
2. The reason for termination must be supported by sufficient factual and regulatory grounds;
3. Notify the trade union (if any) prior to termination;
4. Issue a written termination notice stating the reasons.
