I paid 30 ten thousand yuan as bride price. Can I get it back after divorcing six months into the marriage?

Caili, the "sweet burden" in traditional Chinese wedding customs, has frequently trended online in recent years. If 30 million in caili was paid to bring a bride home, but divorce proceedings begin within six months, can that money be recovered?

I. Legal Provisions: Three Scenarios for Refund

Pursuant to Article 5 of the Interpretation (I) of the Supreme People's Court on the Application of the Marriage and Family Section of the Civil Code, betrothal gifts may be requested for return under the following three circumstances:

1. The parties have not completed the marriage registration formalities.

2. Both parties have registered for marriage but have not lived together.

3. Pre-marital payments that result in financial hardship for the payer.

Note: Scenarios 2 and 3 require divorce as a prerequisite.

II. A Short Marriage Duration Does Not Entitle Full Refund

Many mistakenly believe that "a short marriage duration allows for the return of betrothal gifts." This is a misconception. According to the Supreme People's Court's 2024 new regulations on betrothal gifts: if a couple has registered their marriage and lived together, returning the betrothal gift is generally not supported. However, if the cohabitation period was brief or the betrothal gift amount was excessively high, courts may order partial return based on the specific circumstances.

III. Reference to Fujian Local Case Law

In a case heard by a court in Fujian, the groom paid 28.8 yuan as betrothal gifts. The couple lived together for only 5 months before separating. Considering factors such as the duration of cohabitation, use of the betrothal gifts, and fault on both sides, the court ruled that the bride must return 15 yuan, approximately 52% of the total amount.

IV. Legal Advice

1. Dowry payments should be made within your means; avoid taking on debt to pay.

2. For large bride price payments, use bank transfers and keep payment receipts.

3. Prenuptial agreements can specify the ownership of betrothal gifts.
