How to Calculate Lost Wages from a Traffic Accident? Freelancers, Pay Attention!

Fujian Ciji Law Firm 2026-07-02

You're entitled to compensation for lost wages after a traffic accident. For salaried employees, this is straightforward with pay stubs—but what about freelancers? "I don't have a fixed income, so does that mean I get nothing?" Absolutely not!

I. Legal Provisions on Lost Wages

According to the judicial interpretation of the Supreme People's Court on personal injury compensation cases, lost wages are determined based on the victim's period of missed work and income status. The period of missed work is established by certification issued by a medical institution, while income status falls into three categories:

1. For those with a fixed income: calculated based on the actual reduction in income;

2. For those without a fixed income: calculated based on the average income over the past three years;

3. If unable to prove average income over the past three years, compensation shall be calculated based on the average annual wage of employees in the same or similar industry in the location where the court is seated for the preceding year.

II. Evidence Submission Methods for Freelancers

Although freelancers don't have a fixed paycheck, you can verify your income using the following methods:

- Bank statements: Show consistent income deposits;

- Tax records: Individual income tax filing records are the strongest evidence.

- Contracts and Invoices: Service agreements signed with clients and issued invoices.

- Platform income records: backend revenue data from self-media, e-commerce, and other platforms;

- Industry Association Certification: Proof of income levels within the relevant industry.

III. Practical Tips

1. Preserve proof of income before an incident occurs; prepare in advance.

2. Prefer official payment channels to avoid the inability to provide evidence in cash transactions;

3. File tax returns on time; tax records are among the most recognized forms of evidence by courts.

4. If you truly cannot provide evidence, do not give up. At minimum, you can claim the industry's average wage standard.

IV. Legal Reminder

Lost wages are a key component of compensation in traffic accident cases. Don't forfeit your claim just because you don't have a fixed income. With proper documentation and by exercising your legal rights, your labor value deserves recognition.
